SCFL case makes the news

A Canada-wide weekly newsletter to the legal profession reported on a Court of Appeal case that Francis Lamer and Abbas Sabur won on behalf of SCFL’s client.  The Court of Appeal, in overturning a trial court judgment, clarified an important area of law relating to warranties.  Mr. Justice Chiasson, writing for the three-judge panel, held that an unambiguous warranty clause that allocated all of the risk of inaccurate information to the vendor, regardless of the vendor’s state of knowledge, was enforceable.  The Lawyers Weekly quoted Francis Lamer describing the decision as a “victory for freedom of contract.”
