Robert Danay uses his strong legal research, writing and advocacy skills to successfully guide clients through a wide variety of complex civil, commercial, administrative and constitutional disputes.


Before joining the firm in 2018, Mr. Danay held the position of senior counsel with the Business and Regulatory Law Section of the Department of Justice Canada in Vancouver. During his 15 year tenure with the federal government, Mr. Danay appeared on behalf of the Attorney General of Canada at all levels of court in British Columbia, the Federal Courts, the Tax Court of Canada and the Supreme Court of Canada. These cases included:

  • An action in the British Columbia Supreme Court in which the Court found that the actions of several Canada Revenue Agency auditors had not caused the plaintiff's business losses.
  • An application for leave to appeal to the Supreme Court of Canada in a matter that concerned a decision by the National Energy Board to approve a pipeline;
  • A statutory appeal in which the Federal Court found that the Administrator of an oil pollution insurance fund had violated the duty of procedural fairness in deciding a claim for compensation made by the federal Department of Fisheries and Oceans following an oil spill;
  • A reference in which the Federal Court of Appeal upheld the constitutionality of regulations that required longshoremen in security sensitive areas of marine ports to pass background checks;
  • An action in which the British Columbia Supreme Court held that Status of Women Canada had not defamed the plaintiff when it funded and published a study on the topic of online hate speech.

Mr. Danay has strong academic credentials, including a masters in law from the University of Oxford and a clerkship with the Constitutional Court of South Africa. His legal research and writing has been published both in Canada and internationally in a number of prestigious law journals, including the McGill Law Journal, the University of Toronto Law Journal, the Yale Journal of Law and Technology, the South African Journal on Human Rights and the Hong Kong Law Journal. His publications have been cited by a number of different courts, including the Supreme Court of Canada. Mr. Danay has taught a number of courses and seminars on topics ranging from administrative law, the law of evidence and law and technology at the University of British Columbia, the University of New Brunswick and various continuing legal education seminars.
